Welcome to CHATAROT.AI ("we," "our," "us," or the "Service"). By accessing or using CHATAROT.AI, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and CHATAROT.AI. Please read them carefully.

2. Description of Service

CHATAROT.AI is an AI-powered tarot reading platform that provides:

• Interactive tarot card readings with AI-generated interpretations
• Multiple tarot spreads (single card, three-card, Celtic Cross, etc.)
• Personalized insights based on your questions and selected cards
• Reading history and conversation tracking

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years old (or the minimum age required in your jurisdiction, whichever is higher) to use CHATAROT.AI. If you are under 18, you must have your parent or legal guardian's permission to use the Service.

3.2 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A username
• A secure password

You may also register using third-party authentication services (such as Google OAuth, if available).

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You must not share your account with others or allow others to use your account.

4. Acceptable Use and Prohibited Conduct

4.1 Permitted Use

You may use CHATAROT.AI for personal, non-commercial purposes in accordance with these Terms.

4.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to hack, disrupt, or interfere with the Service's security, servers, or networks
• Use automated tools (bots, scrapers, scripts) to access or extract data from the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate others or provide false information
• Harass, abuse, threaten, or intimidate other users or our staff
• Transmit spam, unsolicited advertising, or promotional materials
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service to distribute malware, viruses, or harmful code
• Resell, redistribute, or commercially exploit the Service without written permission

4.3 Content Standards

When using the Service (such as submitting questions for tarot readings), you must NOT submit content that:

• Is illegal, fraudulent, or violates any laws
• Infringes on intellectual property rights or privacy rights of others
• Contains hate speech, harassment, threats, or promotes violence
• Is sexually explicit, obscene, or pornographic
• Relates to or exploits minors in any way
• Contains personal information about others without their consent
• Is spam, advertising, or solicitation

We reserve the right to remove content that violates these standards and to suspend or terminate accounts that repeatedly violate them.

5. User Content and License

5.1 Your Content

"Your Content" includes any text, questions, or information you submit to the Service (such as tarot reading questions).

5.2 License Grant

By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Store, process, and display Your Content to provide the Service to you
• Use Your Content to generate AI-powered tarot interpretations
• Analyze Your Content in aggregated, de-identified form for service improvement, quality assurance, and security purposes

This license exists only for the purpose of operating and improving the Service. We do not claim ownership of Your Content, and we do not use Your Content for advertising or share it publicly without your permission.

5.3 Your Responsibility

You represent and warrant that:

• You own or have the necessary rights to Your Content
• Your Content does not violate these Terms or any applicable laws
• Your Content does not infringe on the rights of any third party

5.4 Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use, modify, and incorporate such feedback without any obligation to compensate you or provide attribution.

6. Intellectual Property Rights

6.1 Our Content

All content provided by CHATAROT.AI (including but not limited to software, text, graphics, logos, tarot card images, user interface design, and AI-generated interpretations) is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

6.2 AI-Generated Content

Tarot interpretations generated by our AI are created specifically for you based on your input. You may use these interpretations for personal, non-commercial purposes. You may not:

• Claim ownership of the underlying AI technology
• Use AI-generated content to train competing AI models or services
• Republish or resell AI-generated content on a commercial basis without permission

6.3 Trademarks

"CHATAROT.AI" and related logos are trademarks of CHATAROT.AI. You may not use our trademarks without prior written permission.

6.4 Stellar Credits, Payments, and Refunds

CHATAROT.AI may sell Stellar credits that unlock paid features such as Spread Report, follow-up questions, or guidance cards. Stellar credits are for CHATAROT.AI digital services used in entertainment and self-reflection features. They have no cash value, are not transferable, and cannot be exchanged for cash.

• Prices, Stellar credit amounts, and feature costs are shown before purchase or use.
• Daily free Stellar credits are promotional Stellar credits, reset according to our service rules, and do not accumulate.
• Subscription plans renew monthly until canceled. Subscription Stellar credits are granted and reset for each paid billing period and do not roll over.
• Top-up Stellar credits and subscription Stellar credits are tracked separately. The Service spends daily free Stellar credits first, then subscription Stellar credits, then top-up Stellar credits.
• You may manage or cancel a subscription through the Stripe customer portal. Cancellation generally takes effect at the end of the current paid billing period.
• Payments are processed by Stripe. We do not store full payment card numbers on our servers.
• Refund requests are handled under our Refund Policy.
• We may correct account balances if there is a technical error, suspected fraud, chargeback, or payment reversal.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, secure, or error-free

We do not guarantee that:

• The Service will meet your expectations or requirements
• AI-generated interpretations will be accurate, relevant, or applicable to your situation
• Any defects or errors will be corrected
• The Service will be available at all times or free from downtime

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHATAROT.AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from reliance on tarot readings or AI-generated content
• Damages resulting from decisions or actions you take based on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless CHATAROT.AI and its affiliates, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your Content or any content you submit

10. Service Changes, Suspension, and Termination

10.1 Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change features, pricing, or functionality with or without notice
• Impose limits on certain features or restrict access to parts of the Service

We are not liable for any modification, suspension, or discontinuation of the Service.

10.2 Account Termination by You

You may delete your account at any time through the account settings page or by contacting us at [email protected]. Upon deletion:

• Your account and associated data will be permanently deleted
• You will lose access to your reading history and saved content
• Some data may persist in encrypted backups for up to 30 days

10.3 Account Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your account poses a security risk
• We are required to do so by law

We are not liable for any loss or damage resulting from account termination.

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Third-Party Services and Links

The Service may contain links to third-party websites or services (such as AI infrastructure providers, Stripe, AWS, or authentication providers). We are not responsible for:

• The content, privacy practices, or terms of service of third-party sites
• Any transactions you enter into with third parties
• Any damages or losses caused by third-party services

Your use of third-party services is subject to their own terms and policies.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

13.2 Dispute Resolution Process

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, the parties agree to the following resolution process:

Step 1: Informal Negotiation

Before initiating any formal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will work in good faith to reach a mutually acceptable solution within 30 days.

Step 2: Arbitration or Court Proceedings

If informal negotiation fails, disputes shall be resolved through:

• Arbitration: Binding arbitration administered by the Japan Commercial Arbitration Association (JCAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in English or Japanese (as mutually agreed), and the seat of arbitration shall be Tokyo, Japan.
• OR Court Proceedings: If arbitration is not available or appropriate, disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court, Tokyo, Japan.

13.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis only. You waive any right to bring claims as a plaintiff or class member in any purported class, collective, or representative proceeding.

13.4 Consumer Protection Rights

If you are a consumer in a jurisdiction with consumer protection laws that grant you mandatory rights (such as the EU, UK, Australia, or California), nothing in these Terms limits those statutory rights. You may have additional rights that cannot be waived by contract, including the right to bring disputes in your local courts or to a consumer protection agency.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

• Our Service features or functionality
• Legal or regulatory requirements
• Business practices

When we make significant changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Post a prominent notice on the Service

15. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CHATAROT.AI and supersede any prior agreements or understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to any affiliate or successor without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, internet outages, or government actions.

15.6 Language

These Terms are written in English. If translated into other languages, the English version shall prevail in case of any inconsistency or conflict.
